WARRANTY POLICY

One-Year Limited Warranty

Equipment are warranted to be free from defects in materials or workmanship for one year from the date of shipment. Within this period, ULTRAX will, at its sole option, repair or replace any components that fail in normal use. Such repairs or replacement will be made at no charge to the customer for parts or labor, provided that the Company shall be responsible for the inbound freight transportation to ULTRAX. ULTRAX is responsible for the outbound freight transportation cost back to the Company in the continental United States. This warranty does not apply to: (a) cosmetic damage, such as scratches, nicks, or dents: (b) consumable parts, unless equipment damage has occurred due to a defect in workmanship or materials; (c) damage caused by accident, misuse, abuse, flood, fire, or other acts of nature or external causes; (d) the occurrence of any service performed by any party who is not an authorized service provider of ULTRAX; or (e) damage to equipment that has been modified or altered without the written permission of ULTRAX.  The ULTRAX UxCareTM Support Program (covering repair, refurbishment, and like services), provides a one-year limited warranty as noted above. ULTRAX owns all parts removed from repaired equipment unless other contractual terms have been accepted.  ULTRAX uses new and, from time to time, remanufactured parts (meeting the same quality standards as new) in performing warranty repair and other like services.

OTHER THAN THE EXPRESS WARRANTY SET FORTH IN ABOVE, ULTRAX MAKES NO WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE RELATING TO THE EQUIPMENT AND ALL EQUIPMENT IS PROVIDED ON AN “AS-IS” BASIS. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, ULTRAX DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ALL IMPLIED WARRANTIES OF DESIGN, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
